Reinstatement of Sanusi: Court sets date for jurisdictional ruling
The Kano State Government’s attempt to reinstate Emir Muhammadu Sanusi II is being heard by the Kano Federal High Court. The court has set June 13, 2024, as the date to determine whether it has the authority to pursue the issue further.
One of the senior council members of the dissolved Kano Emirate, Aminu Babba DanAgundi, has sued the Kano State Government for his unjustified removal.
The plaintiff’s attorney, Barrister M. A. Waziri, contended that the court is fully authorized to hear the matter.
He pointed out that his client’s rights were violated because he was not granted a fair trial prior to Emir Aminu Ado Bayero’s deposition, which resulted in his removal as senior councillor.
Additionally, he asserted that Sanusi’s reinstatement was illegally obtained and, as a result, void.
Barrister Muhamud A. Magaji, Sanusi’s attorney, however, pleaded with the court to resist the inclination to believe the plaintiff’s claim that it had jurisdiction to pursue the case further.
He maintained that the State House of Assembly unquestionably have the authority to modify, overturn, or even enact laws that are beneficial to the state.
He said that the plaintiff need not be consulted while laws are being made or repealed by the House of Assembly.
Two motions were presented to the court, according to Justice Abdullahi Muhammad Liman, the presiding judge: one seeking jurisdiction and the other to strike aside the order preventing Sanusi’s reinstatement.
He then postponed the decision on whether the court has jurisdiction to continue with the matter until June 13.
